Phenomenal Ascensions LLC provides online support services for scam victims, raising awareness and offering resources for protection. Access and use are at your discretion and subject to compliance with all laws and these Terms.

2. Intellectual Property Rights

We own or license all content, source code, designs, and marks (“Content”). You may access or print limited portions for personal, non-commercial use. Any other use requires our prior written consent.

3. User Representations

By using the Services, you warrant that all information provided is accurate and that you comply with applicable law. You agree not to use automated bots or unlawful means of access.

4. User Registration

You may need to register an account. Keep your password confidential; you are responsible for activity under your account.

5. Purchases & Payment

We accept Visa, Mastercard, American Express, and Discover. You agree to maintain accurate billing information. All charges are in U.S. Dollars and non-refundable unless otherwise stated.

6. Subscriptions

Billing & Renewal: Subscriptions auto-renew monthly until canceled. You authorize recurring billing.
Cancellation: Email [email protected] with subject “Cancellation.” Processing may take up to 10 days.
Fee Changes: We may update pricing with advance notice as required by law.

7. Prohibited Activities

You agree not to misuse or disrupt the Services, post harmful or illegal content, engage in data scraping, impersonation, spam, or any activity violating law or others’ rights.

8. User Generated Contributions

If permitted, you affirm that all content you submit is your own and lawful. Violations may result in suspension or termination.

16. Dispute Resolution

Informal Negotiation

Parties agree to attempt good-faith informal resolution for 30 days before filing arbitration.

Binding Arbitration

Unresolved disputes will be arbitrated under AAA Rules in Dallas, TX. Arbitration is individual-only—no class actions. Certain IP or injunctive matters may proceed in court.

Services are provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied. You use our Services at your own risk.

19. Limitations of Liability

Our total liability shall not exceed amounts you paid within the prior 3 months. We are not liable for indirect or consequential damages.

20. Indemnification

You agree to defend and hold us harmless against claims or losses arising from your use of the Services or violation of these Terms.

21. User Data

We maintain certain data to operate the Services. You are responsible for backing up your own data.

22. Electronic Communications

23. SMS / Text Messaging (TCPA & CTIA Compliance)

Program Description: Phenomenal Ascensions LLC may send optional SMS/MMS texts for appointment reminders, community updates, promotions, or security notices. Message frequency varies.

Opt-In & Express Consent: You can opt in by submitting a form on phenomenalascensions.com and checking the consent box, or by texting START to (737) 497-1627. Consent is not a condition of purchase. You confirm you are the account holder (or authorized) and 18 or older (or have guardian consent).

25. Miscellaneous

These Terms constitute the entire agreement between you and Phenomenal Ascensions LLC. If any provision is invalid, the remainder stays in effect. No joint venture or agency relationship is created hereby.
